Repeat Dud Cheques Could Block Access to New Credit

Bank customers who repeatedly issue dud cheques could lose access to new loans and other credit facilities under a progressive penalty regime outlined by the Bank of Ghana.

The revised rules introduce escalating financial sanctions for first, second and third offenses, while requiring banks to report affected customers to Credit Reference Bureaus and the central bank.

A third offense committed within one year of the first could result in a minimum three-year ban on issuing cheques and a one-year restriction on accessing new credit from Ghana’s banking system.

The Bank of Ghana says the measures are intended to promote financial discipline, discourage the misuse of cheque facilities and preserve confidence in cheque-based transactions.

Dud Cheque offenses Could Affect Creditworthiness

A dud cheque is issued when the account holder does not have enough available funds to cover the amount written on the cheque.

When such a cheque is presented, the bank will reject it and return it unpaid.

Beyond the immediate inconvenience to the recipient, issuing a dud cheque could expose the customer to financial penalties, adverse credit reports and possible legal action.

The Bank of Ghana has warned that reports submitted to Credit Reference Bureaus may affect how financial institutions assess the customer’s ability and willingness to meet future financial obligations.

A poor credit record could make it more difficult for the affected person to obtain a loan, overdraft or another form of credit.

Even where credit is approved, lenders may impose higher borrowing costs or stricter conditions because of the increased risk associated with the customer’s financial history.

First offense Attracts 10% Penalty

For a first offense, the customer’s bank is required to impose a penalty equal to 10 per cent of the face value of the dishonored cheque.

A customer who issues a dud cheque valued at GH¢10,000, for example, could be required to pay a GH¢1,000 penalty.

The financial institution must also send a warning notification to the customer, explaining the consequences of repeating the offense.

Details of the incident must be reported to the Bank of Ghana and licensed Credit Reference Bureaus.

The reporting requirement means the offense may remain relevant when the customer later applies for credit or other banking facilities.

The first-offense measures are intended to give customers an opportunity to correct their account-management practices before more severe sanctions are imposed.

Second offense Raises Fine to 15%

A second dud cheque issued within one year of the first offense will attract a higher financial penalty.

The customer’s bank must impose a fine equivalent to 15 per cent of the face value of the cheque.

The second offense must also be reported to the Bank of Ghana and Credit Reference Bureaus.

The customer will receive another warning explaining the consequences of committing a third offense within the applicable period.

Under the progressive arrangement, the sanctions increase because the customer has repeated the conduct despite receiving an earlier warning and financial penalty.

The central bank expects the escalating measures to encourage customers to verify their available balances before issuing cheques.

Third offense Could End Access to Fresh Loans

The most severe sanctions apply when a customer issues a third dud cheque within one year of the first offense.

The financial penalty rises to 20 per cent of the cheque’s face value.

At that stage, however, the consequences extend beyond the payment of a fine.

The Bank of Ghana will ban the customer from issuing cheques for a minimum period of three years.

The person will also be prohibited from accessing new credit facilities from banks and specialized Deposit-Taking Institutions for one year.

The central bank will notify regulated financial institutions about the ban, preventing the affected customer from attempting to obtain fresh credit or cheque facilities through another institution.

Existing financial obligations will not disappear because of the sanction. Customers will still be expected to meet repayments on loans and other facilities already granted to them.

Credit Reports Could Raise Future Borrowing Costs

The Bank of Ghana has cautioned that adverse reports connected to dud cheque offenses may have consequences even after the immediate penalties have been paid.

Credit Reference Bureaus collect information that financial institutions use when assessing loan applications and determining the level of risk associated with prospective borrowers.

Repeated dud cheque reports could therefore reduce a customer’s credit score or weaken the person’s credit profile.

A customer considered high-risk may face limited access to funds, higher interest rates, stricter collateral requirements or rejection of future applications.

The consequences could be particularly significant for businesses that depend on credit to finance stock, expand operations or meet short-term working capital needs.

Individuals may also struggle to secure loans for housing, education, vehicles or other personal expenses.

Banks Must Recall Unused Cheque Books

After receiving notice of a cheque-issuing ban, a financial institution must inform the affected customer within five working days.

The bank is also required to recall all unused cheque books held by that customer.

No replacement or additional cheque book may be issued until the sanction period has ended and the applicable restrictions have been lifted.

The recall is intended to prevent a banned customer from continuing to issue cheques during the three-year period.

Financial institutions will be responsible for applying the restriction to the affected accounts and ensuring that customers receive formal notice of the action.

Failure to Return Cheque Books Could Bring More Sanctions

A customer who fails to return unused cheque books within 10 working days of receiving the notice could face further regulatory action.

The financial institution must report the non-compliance to the Bank of Ghana.

The central bank may then prohibit the person from operating any current account and add the customer’s name to its Directory of High-Risk Cheque Issuers.

A restriction on operating current accounts could significantly affect individuals and businesses that rely on such accounts for routine commercial transactions.

The additional penalty is intended to ensure that customers comply with the recall process and do not retain cheque books they are no longer authorized to use.

Customers Advised to Check Available Funds

The Bank of Ghana is advising customers to confirm their available account balances before writing cheques.

Account holders should consider not only the balance displayed at the time but also pending transactions that could reduce the amount available before the cheque is presented.

These may include standing orders, direct debits, withdrawals, bank charges and cheques that have already been issued but have not yet been processed.

Customers have also been advised not to issue cheques based only on money they expect to receive later unless they are certain the funds will reach the account before the cheque is presented.

Keeping proper records of issued cheques, their values and expected presentation dates could help account holders avoid unintentionally issuing cheques without sufficient funds.

Where a customer anticipates a shortage, the person should contact the bank promptly and take the appropriate steps before the cheque is presented.

The central bank believes careful account management will help customers avoid penalties, protect their credit records and maintain access to banking and credit facilities.
