Chief Justice Nominee, Justice Gertrude Araba Esaaba Torkornoo says lengthy and notorious land battles which lead to delayed justices of land cases are finding relief through technology-based solutions.
According to her, improvements in digital tools and data systems are transforming how courts deal with land disputes by bringing hope to individuals impacted by enduring legal conflicts.
“We’ve been looking at technology that allows the superimposition of plans very quickly and clearly when cases are commenced. And that’s one area that I’ll be extremely interested in moving along very quickly because a lot of the delay comes not from the fact of the conflict, but from deciding what exactly the issues are and how to resolve those issues”, she said.
Land conflicts have long been a major worry, involving complicated problems like disputed borders, conflicting ownership assertions, and intricate historical documents.
Speaking during her vetting today, Friday, May 26, Justice Gertrude Araba Esaaba Torkornoo emphasized that the arrival of technology is bringing about a new era of effectiveness and fairness in resolving land cases.
“Also, Sometimes parties deliberately start a case in court and don’t want it to end. Sometimes, somebody gets an injunction and then he goes to sleep. And because of the independence of the judiciary, it is not our remit to wake cases up when parties have not come to court.”
“So, we have to begin a new engagement with what our case management rules. If a plaintiff starts a case and it’s not following it up, how do we strike it up? So, technology case management rules again, and then training, increasing the capacity of judges and also lawyers on practical issues”, she added.
