Harold Atuguba, the lawyer representing disqualified presidential candidate Bernard Mornah of the People’s National Convention (PNC), has expressed his disagreement with the Accra High Court’s decision to dismiss their application challenging the Electoral Commission’s (EC) ruling.

Speaking to reporters outside the court, Mr. Atuguba emphasized the lack of clarity in the EC’s communication, arguing that it undermined the fairness of the disqualification process.

He explained that the EC initially notified Mr. Mornah on September 13, 2024, of errors in his nomination forms and gave him the opportunity to correct them, however, the second letter, received on September 20, which disqualified Mr. Mornah, failed to provide any specific reasons.

“The first letter on September 13 informed Mr. Mornah of particular errors in the nomination forms, and those were corrected and resubmitted,” Mr. Atuguba stated.

“However, the letter on September 20, which served as the basis for his disqualification, contained no particulars. If the court had recognized that these two letters were not the same, the conclusion would have been different.”

Bernard Mornah, responding to the court’s ruling, criticized the EC’s handling of the matter and questioned the definition of the “errors” cited in his disqualification.

He argued that the EC failed to explain what specific errors or omissions led to his disqualification and challenged the use of look-alike signatures as grounds for the ruling.

“Look-alike signatures cannot be classified as several errors or omissions—they have specific definitions, the EC presented this issue in court, but the judge failed to address it adequately. This case is far from over.”

Mr. Mornah confirmed his intention to escalate the case to the Supreme Court, adding that he has already instructed his lawyers to proceed with the appeal.

“We’ll take this matter to the Supreme Court so it can be properly determined,” he stated. “We’ll study the judgment critically, but we are prepared to fight this to the highest level.”
