The Supreme Court has granted a motion for substituted service in the case of James Gyakye Quayson, the disputed Assin North Member of Parliament.
By necessary implication, the Writ of Summons against Mr. Quayson will be published once in the Daily Graphic Newspaper, and it will become valid after 7 days.
In this case, Michael Ankomah Nimfah is attempting to prevent James Gyakye Quayson from acting as the Member of Parliament for Assin North.
His writ is based on an earlier High Court decision that declared the Assin North Parliamentary elections invalid and ordered a re-run.
The plaintiff’s lawyer, Michael Ankomah-Nimfa, led by Frank Davies, filed the motion paper and affidavit in support on February 15, 2022, seeking substituted service.
He brought to the Court’s attention the fact that a Bailiff attached to the High Court in Assin Fosu had filed a non-service application, indicating yet another inability to serve the process on Mr. Quayson.
The Court was made up of Justices Jones Dotse, Prof. Henrietta Mensah Bonsu, Mariama Owusu, Agnes Dordzie, Nene Amegatcher, Gertrude Torkornor, and Yoni Kulendi, with Jones Dotse serving as President.
The case has been adjourned indefinitely.
