Bachir Musa Aminou, the man caught with 656 Automated Teller Machine (ATM) cards in his possession, has been granted bail by the Criminal Court 5 Division of the High Court.
His bail is set at GHS 200,000, with two sureties who must be Ghanaian nationals and residents in Ghana.
Each surety must also show that he or she earns a net monthly wage of at least GHS 3,000.
Furthermore, the Court ordered the confiscation and deposit of the accused person’s passport at the Court Registry until the case was resolved.
He must also report to the National Investigations Bureau once a week (on Mondays) until the matter is resolved.
Her Ladyship, Lydia Osei Marfo, presiding, said that the Court would often be sluggish in granting bail to accused people who are foreign nationals and lack substantial links inside the jurisdiction.
Her Ladyship, on the other hand, said that she was obligated to approve the bail application considering the period between the accused person’s arrest and now, as well as the fact that the Prosecution seemed to have no idea when their investigations would end.
Since Bachir Musa Aminou’s arrest, the Prosecution has consistently asked the Court for adjournments to allow investigators to complete their job.
An Assistant State Attorney, Amanda Awade, said in court on Monday that the Republic was set to advise the Court on the status of the investigation.
However, the State Attorney said that she called the lead investigator and was told that the investigators had yet to get replies to letters addressed to the several banks where ATM cards were discovered, as well as the Bank of Ghana.
In this case, Amanda Awade informed the Court that there was no fresh information on developments in the case.
Her Ladyship, Lydia Osei Marfo, stated that “there had been enough time that the Court anticipated the investigators to finish their findings.”
Her Ladyship observed that although the Prosecution had prayed for extension of time on various dates and the same had been granted, the Prosecution “still has not provided any tangible results of their investigations against the accused.”
The case has been postponed until March 23, 2022.
