Cassius Mining wins arbitrator challenge in $277M case against Ghana

Cassius Mining Ltd, through its Ghanaian subsidiary, has successfully challenged the appointment of Professor Richard Oppong as Ghana’s arbitrator in an international arbitration case involving $277 million in claims.

The dispute, centered on alleged breaches of contract and statutory obligations by the Government of Ghana, took a critical turn after Cassius raised concerns about Prof. Oppong’s impartiality.

The challenge, filed on October 23, 2024, questioned his independence, citing his undisclosed nomination to Ghana’s Supreme Court as a potential conflict of interest.

Tribunal Upholds Challenge

The Tribunal, after reviewing submissions from both parties, upheld Cassius’s challenge on January 17, 2025. It agreed that the circumstances presented “give rise to reasonable cause to doubt” Prof. Oppong’s impartiality.

While Prof. Oppong initially refrained from stepping down, he eventually resigned following the Tribunal’s invitation to do so.

The parties have been directed to agree on the timeline and procedure for appointing a new arbitrator to maintain the arbitration’s progress.

Cassius Mining Reacts

James Arkoudis, CEO of Cassius Mining Ltd, welcomed the outcome, stating that the decision to replace Prof. Oppong ensures the integrity of the arbitration proceedings.

“This development reinforces our confidence in the arbitration process and underscores the importance of fairness and impartiality,” Arkoudis remarked.

The Case at a Glance

Cassius filed its claims against the Government of Ghana on December 23, 2024, alleging significant financial damages due to contract violations and statutory breaches.

The claims, supported by witness testimonies and expert analyses, seek approximately $277 million in compensation.

With Prof. Oppong’s resignation, Cassius and its legal team are now focused on selecting a replacement arbitrator and strategizing for the next phase of the proceedings.
