The Cape Coast High Court presided over by Justice Patience Mills-Tetteh has granted a plea made by the Omanhen of Oguaa Traditional Area, Osaabarima Kwesi Atta II to settle the defamatory suit filed by the Metropolitan Chief Executive (MCE) Ernest Arthur out of court.
The MCE on Tuesday, October 26, 2021, filed a defamation suit against the MP for Cape Coast South, Mr. Rickett Hagan following what he described as ‘defamatory comments’ about him.
The Cape Coast High Court in its ruling on 23rd February 2022 ordered the MP for Cape Coast South to retract defamatory statements he made against the Metropolitan Chief Executive (MCE) for Cape Coast within three weeks.
In the court proceedings on Tuesday 15th March 2022, the Lawyer of Rickett Hagan, Michael Monnie Esq filed a motion for the default judgment to be set aside for due processes to take place.
The court subsequently granted the motion and agreed to the out-of-court settlement.
The NDC Secretary for the Cape Coast North Constituency Mr. George Justice Arthur, speaking with the media after the court proceedings indicated that Osabarima Kwesi Atta II pleaded for a 3-week ultimatum to settle the matter at the Emintsimadze Palace.
“That is what we are so elated about because we are also not expecting that this issue will be escalated so that it will be truncated to ensure there is peace and tranquility in our metropolis as well as the constituency,” he said.
The court subsequently slapped a GHS 1,000.00 fine instead of the initial GHS 1,000.00 fine on the MP for damages towards the MCE, Mr. Ernest Arthur.
