A Ho Circuit court has sentenced General Corporal Kwasi Yeboah to 30 months imprisonment for negligently causing injury and unsafe cycling that resulted in the death of one Gabriel Azilaku.
Yeboah pled not guilty to allegations of negligently causing injury in violation of Section 72 of Act 29, 1960 and reckless cycling.
However, following a nearly three-year hearing, the court presided over by Mr. Felix Datsomor found him guilty and sentenced him to 30 months in prison on the first count and three months in hard labor on the other charges.
Over this time period, the sentences will run simultaneously.
The prosecutor, Police Chief Superintendent Akologo Yakubu Ayamga, told the court that the claimant, Emmanuel Awuku, is the deceased’s elder brother, while the prisoner is a police officer posted at Kadjebi and previously at Tefle, Sogakope Police station.
The prosecutor said that on August 8, 2018, at about 1930 hours, the deceased was riding a motorcycle carrying merchandise, and the prisoner, who was on duty at the Sogakope barrier at the time, believed the deceased was smuggling the goods.
According to Chief Supt. Ayamga, the convict then pursued the deceased on his motorcycle with the registration number M-17-AS737 on the Sogakope-Accra route, and upon reaching Sogakope, the convict used his leg to push the deceased’s motorcycle.

He mentioned that the deceased then lost control of his motorcycle and collided with another approaching motorcycle, resulting in an accident. The deceased sustained several head injury and was rushed to the Sogakope hospital, where he died while on admission.
The prosecutor said that after causing the damage, the defendant abandoned the deceased and the other victim and returned to his duty post at the barrier.
According to the prosecutor, the matter was referred to Sogakope police station for inquiry and a duplicate case docket was sent to the Attorney General’s (AG) Department in Ho for guidance, after which the defendant was prosecuted.
