Ghana’s Supreme Court has ordered the removal of James Gyakye Quayson’s name from the parliamentary records as the Assin North constituency.
The unanimous decision follows a ruling that upheld an application questioning the constitutionality of Quayson’s election.
The plaintiff, Michael Ankomah-Nimfah, had previously won a case at the High Court in Cape Coast, which barred Quayson from holding himself as MP.
Quayson, a Canadian citizen, was deemed ineligible to contest as an MP in Ghana due to his dual citizenship as a Canadian and Ghanaian.
The Supreme Court’s decision prevents Quayson from holding himself as a Member of Parliament.
Article 94 (2) says a person shall not be qualified to be a member of Parliament if he owes allegiance to a country other than Ghana.
The former MP had also been facing counts of deceit of a public officer, forgery of a passport, knowingly making a false statutory declaration, perjury, and false declaration.
Quayson’s lawyer, Tsatsu Tsikata, has invoked the review jurisdiction of the Supreme Court to overturn its earlier decision.
