Former Finance Minister Ken Ofori-Atta was medically examined and declared fit before being admitted into detention by United States Immigration and Customs Enforcement (ICE), Ghana’s High Commissioner to the United States has confirmed, providing new clarity on the circumstances surrounding his custody.
Medical assessment before detention
Speaking on PM Express on Joy News, Ghana’s High Commissioner, Victor Smith, said ICE followed standard protocol by arranging for medical professionals attached to the detention facility to assess Mr Ofori-Atta shortly after his arrest. The purpose of the assessment, he explained, was to determine whether the former minister was medically suitable to be held in a detention centre.
According to Mr Smith, the medical team concluded that Mr Ofori-Atta did not present any serious or unstable health condition that would warrant transfer to an external hospital or specialist care. While the former minister was on prescribed medication at the time, he was not under active medical supervision and had access to his medication while in custody—conditions ICE considers acceptable for detention.
ICE officials, the High Commissioner added, indicated that detainees with severe or high-risk medical issues are typically referred to outside medical facilities rather than retained in detention centres.

Consular access and legal representation
Following the detention, Ghana’s embassy in Washington sought consular access to verify Mr Ofori-Atta’s wellbeing and offer assistance in line with diplomatic practice. However, the planned visit did not proceed after the former minister declined to meet embassy officials without his lawyers present.
Mr Smith said the embassy respected that decision and remains available to provide consular support should it be requested at a later stage.
Immigration status questions
Mr Ofori-Atta is currently being held by ICE over questions relating to the status of his stay in the United States. His legal team has confirmed that he is cooperating fully with U.S. authorities and has filed a petition for adjustment of status, which is now pending.
Officials familiar with the process say the outcome will depend on the review of his immigration documentation and compliance with U.S. immigration requirements. No criminal charges have been announced in connection with the detention.
