The Supreme Court has adjourned the injunction application challenging the passing of the Human and Sexual Rights and Family Values Bill by Parliament indefinitely.
The apex court on Wednesday, May 8 presided over by Chief Justice Gertrude Torkoorno cited inappropriate descriptions in the filed documents presented before it during the hearing as having “these persons” by one of the two plaintiffs and “despicable” and “desecration” in processes filed by lawyers of the Speaker of Parliament, Alban Bagbin.
The cases were therefore adjourned indefinitely with the court requesting appropriate language use in their legal fillings.
The Suits by the Plaintiffs; Ghanaian Journalist and Private Legal Practioner, Richard Dela Sky and Human Activist and Researcher, Dr. Amanda Odoi have generated national interest and prevented the presentation of the bill from parliament to President Akufo-Addo from assenting.
The plaintiffs argue that the bill is unconstitutional and void as well as violates the rights of LGBTQ+ people to equality, privacy, and freedom of expression.
Meanwhile, Thaddeus Sory, the lawyer for the Speaker of Parliament argued that the bill is constitutional insisting the plaintiff’s application for an injunction of the bill is unnecessary.
He is therefore seeking a dismissal of the case against the Human Rights and Family Value Bill.
