The High Court has ordered the Graphic Communications Group to apologize and withdraw a false report published against the Food and Drugs Authority’s (FDA) Chief Executive Officer, Delese Mimi Darko.
The order was issued after the Court determined that a story published by the state-owned media house alleging that Delese Mimi Darko was being investigated for being involved in a bribe transaction brought to light in an investigative piece by a journalist indicating FDA’s former head of its legal unit was false.
The judge determined that the harm done to the Plaintiff’s reputation could not be denied to have had a far-reaching impact on her person, therefore the verdict.
The defendant is required to provide an unqualified apology and retraction of the defamatory publication on their online platform within 14 days of the date of judgment and to give it the same prominence as the defamatory statement.
It will be recalled that an investigative report revealed the then-FDA director of Legal Affairs asking a $200,000 bribe from the manufacturer of COA FS to keep his products off the market.
The Graphic Communications Group is accused of releasing the news erroneously, claiming that the Authority’s Executive board had initiated an investigation into the Chief Executive’s involvement in the incident.
