President Akufo-Addo has launched investigations into whether Chief Justice Kwasi Anin-Yeboah should be dismissed from office.
This comes after the lobbying organization Alliance for Social Equity and Public Accountability (ASEPA) filed a petition calling for the Chief Justice’s resignation.
Following accusations by a private legal practitioner, Akwasi Afrifa, that he had sought a $5 million bribe to deliver a favorable verdict in a case involving his client, the Chief Justice (CJ) has been in the headlines in recent weeks.
Since then, Justice Anin-Yeboah has rejected the accusations and requested that the Police CID investigate the issue.
The CJ is unsuitable to hold office, according to ASEPA, and he should be dismissed.
The President, in consultation with the Council of State, must appoint a committee consisting of two Supreme Court Justices and three other persons who are not members of the Council of State, Members of Parliament, or lawyers to investigate the petition and make a recommendation under Article 146(6) of Ghana’s constitution.
According to a letter from Secretary to the President Nana Bediatuo Asante to ASEPA’s Executive Director, the President has started the necessary procedures.
The committee’s hearings will be conducted in secret, with the Chief Justice having the option to defend himself or via a lawyer or any expert of his choosing, as required by the Constitution.
Even before the investigation is completed, the President retains the authority to suspend the Chief Justice on the recommendation of the Council of State.
